Terms of Service

Please read these Terms of Service carefully before using Dexter. By creating an account or using the service, you agree to be bound by these terms.

1. About Dexter

Dexter (the "Service") is a Centralised Activity Tracker (C.A.T.) provided by Whittingham Marketing & Consultancy ("we", "us", "our"), a business based in Brighton, England. The Service is accessible at dexterhub.io.

These Terms of Service ("Terms") govern your access to and use of the Service. By registering for an account, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Your Account

To use Dexter you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately at hello@dexterhub.io if you become aware of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to keep your credentials secure.

You agree to provide accurate and complete information when registering and to keep your account information up to date.

3. Subscription and Billing

Dexter is offered on a subscription basis. The following terms apply to all paid plans:

All prices are displayed in GBP and are inclusive of any applicable VAT unless stated otherwise.

4. Acceptable Use

You agree to use Dexter only for lawful purposes and in accordance with these Terms. You must not:

We reserve the right to suspend or terminate your account immediately if we reasonably believe you have violated these provisions.

5. Your Data

You retain full ownership of all data you input into Dexter, including tasks, tags, notes, and any other content ("Your Content"). By using the Service, you grant us a limited licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

We do not sell, rent, or share Your Content with third parties for marketing purposes. Your data is stored securely using Supabase infrastructure. For full details on how we handle your personal data, please see our Privacy Policy.

You are responsible for maintaining backups of any data you consider critical. While we take reasonable steps to ensure data integrity, we cannot guarantee against data loss.

6. Intellectual Property

The Service, including its design, code, branding, and all content created by us, is owned by Whittingham Marketing & Consultancy and is protected by copyright and other intellectual property laws. Nothing in these Terms grants you any rights in the Service other than the right to use it in accordance with these Terms.

The Dexter name, C.A.T. mark, and associated branding are proprietary to Whittingham Marketing & Consultancy. You may not use them without our prior written consent.

7. Availability and Service Changes

We aim to keep Dexter available at all times but we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Where we make material changes, we will provide reasonable notice to subscribers via email or in-app notification.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your specific requirements, that it will be error-free, or that any defects will be corrected.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Whittingham Marketing & Consultancy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount you have paid to us in the twelve months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
